Advertising terms & conditions (‘Conditions’)

Terms and Conditions governing the IBIDMPTO.com user agreement.

Terms, “us,” “we,” or “our” IBIDMOTO We refer to IBIDMOTO as the website that may be found at htpps://ibidmoto.auction (“IBIDMOTO Trader Website”), as well as all other IBIDMOTO Trader platforms that we control and manage, such as mobile and tablet devices.

Until the advertisement expires, is modified, or is renewed, these terms and conditions will be applicable to all placed, renewed, and/or altered advertisements.

OUR AGREEMENT WITH YOU

Together with all other policies and terms posted on the Ibidmoto Website, these Conditions apply to any vehicle advertisement placed on IBIDMOTO.COM by a private advertiser. They also set out the terms on which we enter into a contract with you to grant you access to our platforms and services.

You are considered to have agreed to these terms by posting an advertisement with us.

A distinct, severable contract is formed between you and us each time we accept your request to post an advertisement on the IBIDMOTO Trading Platform, and it is subject to these conditions.

POSTING AN AD

You will be given a username and password when you post an advertisement on IBIDMOTO, which you are in charge of protecting. In the event that you do not maintain your username and password secure, IBIDMOTO shall not be held responsible. If someone else gains unauthorised access to your account, we won’t be responsible for any losses you could incur, unless it was due to our carelessness. You guarantee that the data you provide while registering will be accurate, complete, and truthful. It is also agreed with that you will not attempt to register under the name of another person or use an objectionable username. All personal data that you have provided as a portion of the registration process will be safeguarded and utilised in compliance with our privacy policy.

IBIDMOTO, which enables a prospective buyer to obtain a history report on the car you’re marketing. In compliance with the aforementioned, if a prospective buyer clicks on the link in your advertisement to purchase a car history check, the vehicle registration mark will be included in the report. If you do not want the car registration mark to be used in this manner, kindly do not submit your advertisement.

If your advertisement is accepted, we try to process and post it online within 24 hours, though we cannot guarantee any specific timeframe.All IBIDMOTO platforms—desktop, mobile, and tablet—as well as any third-party social media network where IBIDMOTO is present may display advertisements. 

You will receive a confirmation email stating that your advertisement has been approved for publication, along with information about when it was online on ibidmoto.com and a unique identification number related to your advertisement. If your advertisement is not accepted for publication, we will make an effort to get in touch with you and provide an explanation. You will not be charged if we reject the advertisement before it is published. Kindly note that until we send you a confirmation email, there will be no legal agreement between you and us.

1. If you purchase a “Advertised until sold” package, this provision will be applicable, and your advertisement will be published for 10 weeks.
2. You will be able to rebook your advertisement for additional ten-week periods at no cost at the conclusion of each ten-week period, and you may do this as often as you like, up until the point at which your vehicle is sold (as long as there isn’t a break in advertising as stipulated in clause 2.7.5 or clause 2.7.4 below).
3. We will send you an email at the end of every ten-week period to enquire about the status of your vehicle sale after eight weeks.
4. We will reschedule your appointment if you respond by the end of the current ten-week period to inform us that your vehicle has not been sold.
5. advertisement for free for a further ten weeks (starting right after the current ten weeks).
6. We’ll erase your advertisement and stop running it if you respond before the current ten weeks are up to let us know that your car has been sold.
7. We will try to get in touch with you via email once more if we don’t hear from you by the end of the current ten-week term. After six weeks, if we don’t hear back from you,
8. If we receive a second email, we’ll assume you don’t want to rebook and will remove your advertisement. There will be a pause in advertising if we remove your advertisement as specified in this clause.
9. The ‘Advertised till sold’ package will no longer allow you to rebook the advertisement for free in the event of a break in advertising, as outlined in clauses 2.7.5 or 2.7.4. You will be charged to rebook the advertisement if you decide to do so after it has been deleted.

Guidelines for Advertiser Content

There can only be one car in each advertisement. You must post a different advertisement for each vehicle if you are selling more than one.

We are only able to show one advertisement for each car at once.

We might accept images and videos of cars for use in advertisements, in a format decided by Ibidmoto. But we reserve the right, at our sole discretion, to exclude a picture or a video from an advertisement.

Unless we specifically instruct you otherwise, you are solely responsible for uploading any images or videos that are a part of your advertisement. We won’t be held accountable for the calibre of any images and/or videos you provide us or upload.

Every advertisement’s content, whether it be text, images, or videos, needs to

show only one vehicle; accurately describe the vehicle that is being displayed; adhere to all applicable laws and regulations; not contain any content that violates any intellectual property rights or other proprietary rights of third parties (such as rights of privacy or publicity); not defame or disparage any individual or organisation; not contain strong profanity or inappropriate content; not be in any way discriminatory or encourage discrimination of any kind; not be pornographic or violent; and not disclose any personal information about any individual (personal information for the purposes of these Conditions is any information that can be used to identify a 

person or make contact with a person by any means); not pretend to be someone else or falsely state that you are associated with a certain individual or business;

not contain any description or mention of illegal activity; not advocate, encourage, incite, or assist any third party in committing any unlawful or criminal act; not contain any statement that would directly or indirectly encourage, prepare, or incite the commission, preparation, or instigation of acts of terrorism;

not contain any advertising, promote any goods or services, direct users to another website, inform users of a promotion that Auto Trader has not approved, or make any other attempt to profit commercially—other than only in relation to the sale of the vehicle that is the subject of your advertisement; not contain any spam;

not be in any language other than English; not include any text or audio that isn’t pertinent to the car being discussed.

 not be unrelated or off-topic, and not include a URL or link to any other website save the advertiser’s own.

Ibidmoto has the right to verify that any such material that appears in the advertisements satisfies the aforementioned standards.

We reserve the right not to publish any photograph or video in your advertisement that does not comply with the requirements outlined in Condition 3.5, to remove any relevant photograph or video from the advertisement, or to remove the advertisement from Ibidmoto entirely.

If you need to make changes to your advertisement, you can utilise Ibidmoto’s online editing tool.

You promise that:

You have the right to sell the vehicle in the advertisement; It does not relate to a vehicle that is a non-declared write-off; Its content is a true and accurate representation of the vehicle to which it relates, and any statement made regarding the mileage of the vehicle being advertised is accurate; Its pricing is consistent and accurate throughout (in both the asking price section and the description), and the mileage has been provided; You are a resident of the United Kingdom or the European Union.

You promise not to commit fraud and to deliver any automobile that is advertised and legitimately purchased from you;

All of the copy, data, and materials you send us are accurate, comprehensive, legitimate, free of libellous language, polite, honest, and truthful.

the advertisement that we publish won’t violate any contracts, violate the intellectual property rights or other rights of third parties, expose us or any other company in our group to legal action, harm our reputation or the reputation of any other company in our group; you won’t upload any files to Ibidmoto that are infected with viruses or contain corrupted data; and the advertisement conforms with these conditions, including without limitation Conditions 3.1 to 3.5.

Any mention of a car being “Sold” in an advertisement will result in its instant removal from Ibidmoto. 

OUR DUTIES AND RIGHTS

We promise to deliver the advertising service in a timely, professional manner, with appropriate care and expertise. You do, however, understand and agree that there is no way to ensure that Ibidmoto will always be accessible online or that an advertisement will be transferred to Ibidmoto without corruption or error.

We will occasionally need to perform maintenance on our systems and equipment, and we will make every effort to minimise any disruption to our advertisements during this time.

We promise to make every effort to quickly fix any flaws or errors on Ibidmoto.com.

[You understand and agree that it could take us up to 48 hours to look into and fix a malfunction or issue once it has been reported to us].

You acknowledge that the content of your advertisement is entirely your responsibility, and neither we nor anyone else will be in charge of it. As a result, you will be liable for any losses, charges, or other expenditures that we incur as a result of a false statement or erroneous or illegal information.

We reserve the right, at our sole discretion, to refuse to publish any advertisement without cause and to categorise, modify, or remove any advertisement in order to: uphold any moral or legal obligations owed to you or us; prevent infringement on the intellectual property of third parties. reply to any

address any concerns raised; fix any typos or technical inaccuracies that occasionally crop up; and address any other technical or quality-related issues. We will make every effort to get in touch with you in order to notify you of these modifications before they are published and/or edited.

Any content from the advertisement that, in our judgement, violates the law or these terms may be removed at any time.

For operational purposes, we reserve the right to change Ibidmoto’s technical specifications at any moment, in whole or in part.

Please be advised that sending vehicle photographs with any message you send through Ibidmoto’s messaging service may prevent the message from reaching its intended recipient.(based on the size and quantity of photographs as well as your device). If such a communication is not delivered, Ibidmoto shall not be responsible for any loss or harm you may suffer. It is advisable that you post the photographs in your advertisement and point prospective customers there.

Fees and Payment

The price of running an advertisement on IBIDMOTO is determined by the advertising package you choose; ibidmoto.com provides a quote for all costs. VAT is already included in all pricing.

We reserve the right to alter our advertising prices at any time and for any reason, but any changes won’t affect any ads that were placed with us prior to the revised prices being published.

Prior to publication, all advertisements must be paid in full.

Online payment for advertisements is handled by ibidmoto.com. Payments cannot be made over the phone with us.

In cases when Ibidmoto is used to collect money, we will direct you to a specialised merchant who will process your payment using a secure server (SSL) connection to guarantee the security of your online transaction.

Visa, MasterCard, or Maestro are accepted forms of payment. Despite our best efforts to guarantee the security of your credit card transaction, we cannot and will not be held responsible for any losses or damages resulting from the use of the secure payment mechanism.

RIGHTS TO INTELLECTUAL PROPERTY

You provide us a non-exclusive, irreversible, perpetual, royalty-free license to use any materials (the “Materials”) that you provide to us for any purpose. You certify that you will not, nor will anyone else, use the Materials mentioned above to claim any moral rights against us or any other party.

You acknowledge and agree that we will be the sole owner of all intellectual property rights (including, but not limited to, copyright, trademarks, database rights, and design rights, whether registered or not) in any text, artwork, photos, videos, or other materials that we have created or modified for you in correlation with the advertisement.

OUR RIGHT TO END THE AGREEMENT

We reserve the right to end our agreement with you and take down any advertisement at any time. We will notify you when your advertisement is removed. Unless we have cancelled the contract in accordance with Condition 7.2 below, we will reimburse you for the portion of the advertising term that has not yet expired in such circumstances.

We reserve the right to instantly stop or end the agreement and delete any advertisement where:

You violate one or more of these terms; you violate any of Condition 3.8’s provisions; we have a good reason to believe that you are not abiding by Condition 3.8’s requirements;

you advertise at our discounted rate, but you charge more for your car than the amount that the discounted cost is good for;

You post an advertisement for one car, then change the advertisement’s details to sell many cars;

If, in our reasonable judgement, there is cause to suspect that you have mistreated our employees, or if we receive a complaint from a third party concerning your actions in connection with the sale of a vehicle that was advertised, and/or if any law enforcement or compliance body of competent jurisdiction directs, counsels, or suggests that we take certain actions,

If we remove an advertisement in line with Condition 7.2 above, you won’t be eligible for a refund for that particular advertisement.

RIGHT TO TERMINATE

Please be aware that the digital advertising package offered by IBIDMOTO is custom-made, made right away, and based on your specifications. You are requesting that IBIDMOTO construct and publish your advertisement within the legally permitted 14-day cancellation period for customers when you submit your advertisement to us for publication. Once your advertisement is live on ibidmoto.com, IBIDMOTO will have completed our advertising service. This implies that after your advertisement goes online, you will not be able to cancel your advertising package and you won’t be eligible for a refund if you decide to have it taken down.

By submitting your advertisement for publication, you agree that you will forfeit your claim to a refund and that you will not be able to terminate your advertising package contract at no cost to you.

You can remove an advertisement at any time, for instance, to stop receiving unsolicited answers, but unless you cancel your advertising package because we broke the terms of the agreement, there will be no returns.

Accountability

Nothing in these terms will limit or eliminate our liability for fraudulent misrepresentation, death or personal damage brought on by our negligence, or any other liability that the law forbids us from excluding or limiting.

If we don’t follow these terms, we’ll pay for any loss or damage you sustain that is reasonably foreseeable as a result of our negligence or a breach of these terms; however, we won’t pay for any unforeseeable losses or damages or losses that aren’t the result of any violation on our part.

If loss or harm were an evident result of our violation, or if you and we both considered it at the time the advertisement was published and the contract was established, then it would be foreseeable.

Because of your use of Ibidmoto or your downloading of any content posted on it or on any website linked to it, we disclaim all liability for any loss or damage caused by a distributed denial of service attack, viruses, malicious or impairing computer programs, or other technologically harmful material that may affect Ibidmoto, your advertisement, and/or may infect your computer equipment, computer programs, data, or other proprietary material.

We make no promises as to whether you will sell the car after posting an advertisement on Ibidmoto, and we don’t promise to find a buyer on your behalf. Our only responsibility is to offer you a platform so you can list your car for sale.

When you post your advertisement, Write-off Checks (discussed in Condition 2.2) are generated using information provided by an impartial third party. The offered results are current as of the advertisement’s placement date. Regarding the correctness of any Write-off Check results that appear in an advertisement, we shall not be held responsible.

Before placing your advertisement, it is your obligation to review the Write-off Check results and decide whether you still want to move further. We disclaim all liability for any loss you may incur as a result of any write-off checks.

If you are successful in selling your car as a result of putting an advertisement, Ibidmoto will not have any involvement in the transaction and will not be held accountable for any agreements you make with third parties about the sale of your car.

You acknowledge that we will not be held liable for any queries or grievances you may have about a car that you advertised, and that you will be the only one handling these matters.

If an advertisement contains an error or omission, we reserve the right, in our sole discretion, to either change the offending portion of the advertisement or to modify the fees.

If, in our sole judgement, the error or omission does not materially detract from the advertisement or if it results from inaccurate or insufficient information that you have provided, there will be no refund, revision, or adjustment to the charges.

If an event beyond our reasonable control causes a delay or prevents us from fulfilling our obligations to you, we won’t be held responsible. Examples of such events include acts of God, fire, flood, explosion, storm, epidemic, or natural disaster; strikes; terrorist attacks or threats of terrorist attacks; infrastructure failure or power outage; denial of service attacks; or failure of public or private telecommunications networks.

Nothing in these Terms impacts the lawful rights you may have. You can get information about your legal rights from Trading Standards or your local Citizens Advice Bureau.

Security and protection of data

We take security extremely seriously, and on the Ibidmoto website, we offer guidance on how to make sure you and your family are safe and secure while selling your car. You can find this information in the Safety & Security Centre.

You are requesting that your advertisement appear on Ibidmoto.com by sending it to us. This implies that anyone with internet access anywhere in the world may be able to read the advertisement and all of the information it contains. You provide permission for your data to be published in this manner.

To safeguard our customers’ privacy, we use a customer-to-customer messaging service and Protect My Number.

Customer to Customer messaging allows people to contact you through a link on your advertisement without knowing your actual email address, thereby hiding it from people who are viewing it. It is required that you do this. When you post an advertisement with us, you understand and agree that any correspondence you have with those who see it will come through your authorisation to use our customer-to-customer messaging service.

You understand and consent that by placing an advertisement with us, you will give us certain personal information about yourself, which we will gather from you (such as your name, address, and contact information). This personal information may be used for a variety of purposes (as further explained)and will be treated in compliance with our privacy policy.

This personal information will be handled in compliance with our privacy policy and may be used for a variety of reasons (further described in our privacy policy), such as preventing and detecting fraud, supporting law enforcement investigations and/or enquiries, and/or meeting legal and regulatory requirements. OVERALL

We may assign our rights and duties under these Terms to any third party, but we will always give you written notice whenever we do so. Your rights and our duties under these Conditions will remain unaffected.

These Conditions’ paragraphs function independently of one another. The following paragraphs or sections shall continue fully operative even in the event that a court or other appropriate authority rules that any one of them, or any portion of them, is unlawful.

It will not indicate that we have waived our rights against you or that you are exempt from fulfilling your duties under these Conditions if we refuse to insist that you fulfil any of them or if we take longer than necessary to do so.

We will only waive such obligation by you in writing, and doing so will not imply that we will automatically forgive any subsequent default on your part.

A contract is formed between you and us by these conditions. Nobody else will be able to enforce them in any way.
